In order to show the validity of here proposed conception of social ontology and its advantages over descriptive theories of social reality, which in the analysis of the socio-ontological status of human rights find only legally understood normativity as present in social reality, we will first lay out Searle’s interpretation of human rights. In the second step, we will introduce the methodical approach and basic concepts of our socio-ontological position, and explain the structure of the relationship between justice, law, morality, (...) social institutions and collective intentionality. At the end we will show how our theory of social ontology is better than Searle’s legal positivism in examining the ontological status of human rights. At the end, we show in what ways such a theory of social ontology more intuitively and with wider arguments explains the ontological status of institution of human rights than Searle’s legal positivism. Marija Velinov, Foucault/Derrida Fifty Years later: The Futures of Genealogy, Deconstruction, and Politics, Columbia University Press, New York, 2016).

This paper argues that there is continuity in Foucault?s thought, as opposed to the common division of his work into three phases, each marking a distinct field of research - discourse, power, subject. The idea is that there are no radical turns in his work that justify this division; rather, there is a shift of focus: all crucial concepts are present in all periods of his thought and in all of his undoubtedly differently-toned and oriented works. This is shown through (...) examining the characteristics of archaeology and genealogy, their relation, as well as the relation of discursive practices and strategies of power to knowledge. The retrospective and interpretation intend to shed light on the constant interplay between concepts that demonstrate continuity in Foucault?s thought. The viewpoint, based in the integrity of Foucault?s work, offers a better starting point for understanding certain aspects of his theories. (shrink)

Insbesondere dadurch was der Autor als "souveranes Vergehen" und "idealistische Casur" beschreibt. Die Grundlinien dieser Arbeit kehren zuruck zu den grundlegenden Figuren der Philosophie Hegels und ziehen sich auf den Problemkreis des Verhaltnisses zwischen des Rechts und der Geschichte, in Rucksicht auf die konstitutive Rolle der Gewalt bei jeder Institutionalisierung des Rechts und der Begrundung neuer Lebensgestalten, zusammen. Das Hauptthese konzentriert sich auf das Bestehen der dialektischen Kluft innerhalb der Hegelschen Differenzierung zwischen der Freiheitsvollendung im Staate und dem philosophischen Wissen, das fur die Weltgeschichte grundlegend ist: der Begriff der absoluten Freiheit, der in seiner Abstraktheit in der Weltgeschichte seine Kraft der Zerstorung zeigt, ist gerade dasselbe, was am Begriff der Philosophie selbst tief geschichtlich ist, worin er aber seine konkrete Macht bei der Entstehung neuer normativer Ordnungen mit sich bringt. Der Betrachtung liegt dabei die Frage zu Grunde, ob der späte Heidegger sich mit den Begriffen Gestell und Gelassenheit überhaupt noch im Sinne grundlegender Gestalten der mensch- lichen Lebensweise auseinandersetzt, so wie er es in den 30er Jahren tat und behauptete. Weitergehend wird die Beziehung des Begriffs der Gleichförmig- keit, verstanden als eine Folge der technischen Herrschaft über die Erde, (...) zu C. Two authors with a similar philosophical biography write this letter from Serbia. First the German professor is introduced to the history of Serbian philosophy. Special attention is given to the relations between German and Serbian philosophy. Subsequently, the present situation of philosophy in Serbia is described, including the toil and deprivation implied in occupying oneself with philosophy in this country. The authors demonstrate that in these circumstances, enthusiasm and personal dedication are of the essence.

In dieser Arbeit werde ich versuchen zu zeigen, dass die Frage nach der Natur der Erde, die eine der ersten Fragen des frühen Kants ist, sowohl in der Kritik der Urteilskraft, als auch in dem schriftlichen Nachlass , wieder zum Zentrum seines philosophischen Denkens kommt. Der späte Kant verbindet diese Frage streng mit dem Prinzip subjektiver Zweckmäßigkeit und kritisiert im Opus postumum, insbesondere im Anschluss an den Übergang von den metaphysischen Anfangsgründen der Naturwissenschaft zur Physik, die übliche Erdauffassung als den (...) Besitz der menschlichen Gattung und findet, aufgrund des Zweckmäßigkeitsprinzips, welches für die teleologische Urteilskraft maßgebend ist, dass es notwendig ist, das menschliche Verhältnis zur Erde wesentlich mit Rücksicht auf die körperlich-geographischen Grenzen unserer Erkenntnis zu überprüfen. In der Kantischen Philosophie finde ich die Idee einer zweckmäßigen Geoethik, die sich mit dem Problem der menschlichen Sesshaftigkeit auf der Erde und mit ihrer räumlich-moralischen Orientierung in der Welt beschäftigt. Die Welt der Vernunftwesen wird sich daher ihrer geo-ethisch-rechtlichen Grenzen bewusst. Daher legt Kants Auffassung der Zweckmäßigkeit die Grundlage für die Formulierung einer Ekopolitik, die nach dem Zusammenwirken zwischen dem Menschen und seiner Umwelt fragt. (shrink)

Der Beitrag diskutiert die Beziehung und gegenseitige Beeinflussung zwischen negativen Emotionen und Kultur. Es werden Argumente vorgebracht, auf Grund deren sich die negativen von den positiven Emotionen unterscheiden lassen. Es wird argumentiert, dass der Unterschied in der für die negativen Emotionen charakteristischen Intentionalität liegt, die auf das Subjekt selbst gerichtet ist und es zu ihrer Geisel macht. Obwohl es auf den ersten Blick intuitiv falsch erscheinen mag, wird argumentiert, dass sich die negativen Emotionen positiv auf das soziale Leben auswirken und (...) dazu dienen können, die menschlichen Werte und Ziele gegen die bestehenden Ungerechtigkeiten zu fördern. Die Bewertung feindlicher Emotionen bezieht sich auf die Übereinstimmung mit relevanten sozialen und persönlichen Normen, d. h. auf die Beurteilung sozialer Ereignisse anhand ethischer, moralischer oder sozialer Werte. In addition to Axel Honneth?s thesis on the therapeutic function of the concept of ethical life in Hegel?s philosophy, I want to underline two moments which, to my mind, show Hegel?s views on the therapeutic dimension of both philosophy and the war against the pathology of civil society more clearly. In this context, philosophy performs a corrective function by fostering the individual?s virtue conceived as an ethical duty of care both for oneself and for others. The main aim of Hegel?s (...) practical philosophy is hence to return the individual from abstract subjective concepts to his concrete everyday intersubjective practices, and to show him the way to understand himself and the social world as originally related to each other; one of the main problems for the moral development of individuals consists in their propensity to perceive the good in particularist and selfish terms: in this context events such as natural disasters or wars can be seen as performing a therapeutic function by teaching individuals to view the good in more principled and general terms. Ihre?unwirtliche Stelle? innerhalb seines philosophischen Systems kann uns nicht nur die Hegelsche Auffassung von dem Ph?nomen des Politischen erkennen lassen, sondern verweist uns auch auf die Stetigkeit der Entzweiung zwischen dem globalen Feld des politischen Ereignis als empirisch konstitutiv und ihrer?universellen??berwindung. Die Sph?re des Politischen wurde damit f?r das gegenw?rtige philosophische Denken als mit (...) einer?Rest der Negativit?t? bestimmend gezeigt und das Verh?ltnis zwischen der Philosophie und dem Staat wurde fruchtbar f?r eine zuk?nftige Betrachtung ge?ffnet. Namera mi je da u sklopu?iznenadjujuce? aktuelnosti u poslednje dve decenije Hegelove politicke filozofije podvrgnem analizi status medjunarodnih odnosa u Hegelovoj Filozofiji prava. Smatram da nam?negostoljubivo mesto? tog odseka unutar njegovog filozofskog sistema moze osvetliti, ne samo Hegelovo shvatanje fenomena politickog, nego i konstantnost rascepa/ razlike izmedju globalnog polja politickog dogadjaja kao empirijski konstitutivnog i njegovog?univerzalnog? prevladavanja. Sfera politickog ce se na taj nacin pojaviti za savremeno filozofsko misljenje kao sustinski odredjena jednim?ostatkom negativnosti?, a odnos izmedju filozofije i drzave plodno otvoriti za neko buduce razmatranje. The problem I wish to address here is how Edith Stein‘s theory of shared empathy and psychotherapeutic group therapy are required condition for any successful work with patients in medical and clients in philosophical praxis. Moreover, a theory of shared empathy must also account for the arguably more intricate issue of how group members might properly share an own mental domain with its distinctive phenomenology, and its distinctive attitudes toward one another, so that the necessarily self-testimonies of clients does not (...) rest on a previous pathological state. In the following, I aim to offer some steps towards solving this problem. I will do so by outlining what methodology lies behind the theory of shared empathy, and showing how, on the results of a case study, it can be applied in a way whereby it still accommodates all requirements for what counts as valid coherence of self-testimony and successful client’s healing. The article analyzes Heidegger?s relation to National Socialism based on his private writing in the?Black Notebooks,? published in their entirety this year. Although it is indisputable that Heidegger was an enthusiastic adherent of the National Socialist program between 1930 and 1934, his private writings show his avowed philosophical delusion that the National Socialist?revolution? in Germany was going to bring about a new beginning of philosophy beyond the metaphysical tradition. The aim of this paper is to outline the history of anticommunist legislation in interwar Yugoslavia and to bring to the fore its key phases. This approach is employed to re-examine the effectiveness of the introduced laws, to pinpoint their shortcomings, but also their strong points. Virtually from its creation, the Kingdom of Serbs, Croats and Slovenes (Yugoslavia) was hostile to communism. Anticommunist convictions of the ruling elites influ­enced many aspects of governance, not only internal affairs, as the outlawing of (...) the Communist Party of Yugoslavia in December 1920, but also foreign policy, as postponing the recognition of the Soviet Union to 1940. There are three distinct phases of anticommunist legislation, each clearly marked by a key anticommunist law. During the first phase (1918-1921), there were few legal instruments for combating left-wing radicalism. The second phase (1921-1929) was marked by the introduction of a highly controversial Law on the Protection of Public Security and State Order, which gave previous unprecedented powers to the prosecutors and police to crush the emerging communist movement. This legal framework was further expanded after the proclamation of the King`s dictatorship in 1929, and the overhaul of the Law, as well as the introduction of a special tribunal – The State Court for the Protection of the State. Starting from recent formulas of EU bureaucracy for subordinating scientific and educational apparatuses to the needs of the capital and to the requests of its political representatives, the article analyses the interconnection between the historical transformation of the ideological state apparatuses and the epistemological discontinuity provoked by the triumph of technosciences. The hypothesis to be tested is the following: While the crisis of West European-North American capitalism requires an ever tighter submission of ideological state apparatuses, and especially of scientific and (...) academic apparatuses to the needs of the capital, theoretical practices in the humanities and social sciences have come to the point where they entered into an open conflict with the domination of the capital and have, as a consequence, started to subvert their own institutional supports in the ideological apparatuses of the capitalist state. For this purpose, the article reconsiders social sciences as a compromise formation and, eventually, reassesses the historical materialism as a non-Cartesian modern science. Polazeci od skorasnjih formula EU birokratije putem kojih se naucni i obrazovni aparati podredjuju potrebama kapitala i zahtevima njegovih politickih predstavnika, ovaj rad analizira uzajamnu povezanost istorijske transformacije ideoloskih aparata drzave i epistemoloskog diskontinuiteta koji je izazvan trijumfom tehno-nauka. Ispitivacemo sledecu hipotezu: iako kriza kapitalizma u Zapadnoj Evropi i Severnoj Americi zahteva sve cvrsce podredjivanje ideoloskih aparata drzave - narocito onih akademskih i naucnih - teorijske prakse u humanistickim i drustvenim naukama su dosegle tacku otvorenog sukoba sa dominacijom kapitala, cime su sledstveno pocele da podrivaju sopstvena institucionalna uporista u ideoloskim aparatima kapitalisticke drzave. U tu svrhu, rad preispituje drustvene nauke kao jednu kompromisnu formaciju i, naposletku, iznova razmatra istorijski materijalizam kao ne-kartezijansku modernu nauku. (shrink)

My aim in this article is to defend the view that art is a relevant source of knowledge, including moral knowledge, in the absence of empirical evidence corroborating this view. In the first part, I discuss what is known as the causal question, that is, the question regarding art's impact on spectators. I argue that the alleged failure of art to impact us may be a matter of moral motivation and the particular circumstances of moral reasoning more than the cognitive (...) and ethical character of a work. To support my claim, I rely on contemporary research on moral reasoning. I conclude by sketching a wider context within which we should consider art's impact, stressing the relevance of cognitive sciences and moral psychology. (shrink)

We argue that there is a variety of convention, effective coordinating agreement, that has not been adequately identified in the literature. Its distinctive feature is that it is a structure of conditional we-intentions of parties, unlike more familiar varieties of convention, which are structures of expectations and preferences or obligations. We argue that status functions constitutively involve this variety of convention, and that what is special about it explains, and gives precise content to the central feature of status functions, namely, (...) that objects with status functions can perform their functions only insofar as they have been collectively accepted as having them. In this article, I defend the cognitive value of certain generic television series. Unlike media and television scholars, who have been appreciative of the informative capacity of television fiction, philosophers have been less willing to acknowledge the way in which these works contribute to our understanding of our social reality. My aim here is to provide one such account, grounded in aesthetic cognitivism, that is, the view that fiction is a source of knowledge. Focusing on crime and courtroom dramas, I (...) start by offering some examples of the cognitive benefits available in some of these series and I argue that the more beneficial cases establish superior mimetic relations with reality, enhancing their capacity to present ethically challenging issues. I then examine whether the fictional dimension of these works presents an obstacle to their informative potential and I conclude that it does not. A central aspect of my account is the claim that the degree of cognitive benefit depends on the underlying narrative strategy of the series. Specifically, there are clues in any given show, including the treatment of ongoing characters, which signal the extent to which it can be taken as mimetically reliable and thus, cognitively valuable. I complete my account by addressing anti-cognitivists’ arguments which call to doubt the informative aspect of television series and their capacity to address ethical concerns. (shrink)

Strawson style counterexamples to Grice’s account of communication show that a communicative intention has to be overt. Saying what overtness consists in has proven to be difficult for Gricean accounts. In this paper, I show that a common explanation of overtness, one that construes it in terms of a network of shared beliefs or knowledge, is mistaken. I offer an alternative, collectivist, model of communication. This model takes the utterer’s communicative intention to be a we-intention, a kind of intention with (...) a distinctive content that cannot be reduced to an intention in favor of an individual action. I show that the collectivist model can explain overtness in terms of a general feature of we-intentions, namely the requirement that the participants in a shared activity are to intend to act in accordance with meshing subplans. This article lies at the intersection of two problems: the one concerning the potential of fictional works to inform us about our social reality and foster our understanding of its various aspects, and the one concerning their potential to engage with philosophical issues. I bring these two together by analyzing the hit television series Law and Order: Special Victims Unit. According to my interpretation, the series is informative about our social world, and it raises philosophical concerns about it. This makes (...) it well-equipped to fulfill the educative function attributed to mass art by Noël Carroll, and to stand out as an example of what he calls popular philosophy. To support this interpretation, I rely on contemporary views regarding the nature of our engagements with fictional narratives. I then explore how philosophical concerns are generated and I elaborate on the role they have in deepening one’s understanding of one’s social circumstances. I further show how the series provides innovative and independent philosophical knowledge by means specific to the medium of generic serialized fiction. The central part of my argument is an analysis of the narrative strategies which enable the informative and philosophical aspects of the series to generate the series’ educative function. (shrink)

While pragmatism as a philosophy and intellectual movement has been gaining inroads in international ethics and international political theory scholarship, feminist pragmatism is not yet as widely regarded. This paper explores the intellectual contributions of feminist pragmatism to international political thought, particularly Jane Addams’s social ethics which is largely overlooked in the literature on women’s contributions to international normative theory. Here I add to efforts to reconsider Addams as a thinker that was concerned with the multiplicity and diversity, features of (...) social life that make a foundational premise of international normative thought. In the paper, I explore how feminism and pragmatism challenge ideas about normatively constitutive communities. The nexus of the two philosophies come clearly in Addams’s progressive communitarianism and her ideas on the significance of settlement to social ethics. In addition to Addams’s pacifist thought and international humanism, I argue that her practice in Hull House draws attention to the site as a normatively significant category. The paper casts Hull House as an international social space that sustained social connections, instrumental to social ethics. Hull House serves as an exemplar that can inform further thinking about the international community and more democratised global governance structures. (shrink)

In this chapter, we focus on collective action and intention, and their relation to conventions, status functions, norms, institutions, and shared attitudes more generally. Collective action and shared intention play a foundational role in our understanding of the social. -/- The three central questions in the study of collective intentionality are: -/- (1) What is the ontology of collective intentionality? In particular, are groups per se intentional agents, as opposed to just their individual members? (2) What is the psychology of (...) collective intentionality? Do groups per se have psychological states, in particular propositional attitudes? What is the psychology of the individuals who participate in collective intentional behavior? What is special about their participatory intentions, their we-intentions, as they are called (Tuomela and Miller 1988), as opposed to their I-intentions? (3) How is collective intentionality implicated in the construction of social reality? In particular, how does the content of we-intentions and the intentional activity of individual agents create social institutions, practices and structures? -/- We first discuss collective action and shared intention in informal groups. Next we discuss mechanisms for constructing institutional structures out of the conceptual and psychological resources made available by our understanding of informal joint intentional action. Then we extend the discussion of collective action and intention to institutional groups, such as the Supreme Court, and explain how concepts of such organizations are constructed out of the concepts of a rule, convention, and status function. Stanley and Williamson :411–444, 2001) argue for intellectualism—the thesis that knowing how is a type of knowing that—in part by defending a thesis about the semantics of English ascriptions of knowing how. But ascriptions of practical knowledge seem to exhibit significant crosslinguistic variation. This observation has been invoked to argue that S&W’s analysis reflects a quirk of English rather than a general feature of the concept of knowledge. I argue that the type of argument employed by both S&W and their (...) critics presupposes that the categories of denotational semantics correspond to those of the theory of mental content. But the relation between the semantic theory and the theory of content is more complex than this. Specifically, a closer look at ascriptions of practical knowledge and other obligatory control constructions in various languages shows that semantic theory needs distinctions that are redundant from the perspective of the theory of content, and that important distinctions in the theory of content may fail to correspond to any distinctions in semantic theory. It follows that we may not be able to read off as much about mental states as S&W and their critics try to from the structure of their ascriptions. (shrink)

The notion of the Anthropocene is founded on the premise that traces of human activity on the earth will remain legible in the geological strata for millions of years to come, showing evidence of an anthropogenic 'signature' inscribed in the rock by the human species. Spectrality and Survivance shows how embedded in this understanding of the Anthropocene is a speculative and specular gesture that transforms the notion of the future into an anthropocentric reflection of the present, prohibiting any true engagement (...) with the possibility of a non-anthropocentric and post-anthropocenic world. In this volume, Marija Grech develops an alternative conceptual paradigm from which to think the Anthropocene beyond any limited notion of human language, human thought, human systems of meaning, or even a human world. Grech considers how the geological trace of the Anthropocene might be said to 'survive' outside of the possibility of any human readership, and how the very survival of the human in and beyond the Anthropocene might necessitate such thought. For some, this is a proof of an intricate connection between democracy and moral relativism. The ‘militant democracy’ model, on the other hand, is premised on the idea that certain political actors and choices have to be banned for being fatally bad for democracy. This gives rise to the claim that protected democratic fundamental values of (...) freedom and equality enjoy the status of absolute moral standards. This article dismisses the intuition that justification of ‘militant democracy’ depends on unpacking the relation between democracy and meta-ethics. Instead, following Bernard Suits’ analytical exposition of the important features of games, it demonstrates, first, how democracy is like a game and, then, it argues that a plausible justification of ‘militant democracy’ stems from its game-like character. Once widely spread in the Dinaric Mountains part of the Balkan Peninsula, swearing to virginity was a social and cultural custom recorded among all groups inhabiting the area. In the absence of a capable adult man in the household, a daughter would take over his social role by ‘becoming’ a man. The standard explanation is that the function of this practice is enabling the continuation of the household’s economic, social, and religious activities. We argue that this explanation fails. A better (...) explanation is that, because the lack of a particular kind of a man (competent and honourable) was perceived as a shame in these societies, the primary reason for swearing to virginity was saving family honour.
